Utbyggingsavtale

Lovfestet betegnelse på avtaler inngått i kraft av planmyndighet, mellom planmyndighet  og utbygger om planlegging og gjennomføring av utbyggingsprosjekter. Men generelt brukes også termen om avtaler vedrørende utbygging mellom kommune ev. annen offentlig grunneier og utbygger. Utbyggingsavtaler inngås i medhold av plan- og bygningsloven, alternativt den frie avtaleretten. Avtalens formål og innhold vil kunne variere med kommunens utbyggingspolitikk, utbyggingssituasjon og mer spesifikt med partenes interesser.

Adgangen til å bruke utbyggingsavtaler til å avkreve utbyggingsbidrag for inndekning av byutviklingskostnader er begrenset til i hovedsak å gjelde områdeintern infrastruktur, og eventuelt områdeekstern infrastruktur som nødvendig vilkår for å kunne gjennomføre utbyggingen.

Land development agreement

Statutory term characterizing planning authority led agreements, between the planning authority and the developer regarding projects’ planning and implementation. Generally the term is also used for agreements regarding development between the municipality as landowner, alternatively another public landowner and the developer. The concluding of a land development agreement is based on the Planning and Building Act, alternatively contractual law.  The purpose and content of these kinds of agreements will be varying with the municipalities’ development policies, the actual local situation and, more specifically, with the interests of the negotiating parties.

The legality of using such agreements to exact contributions for the covering of urban development costs has been constricted mainly to internal infrastructure, or contingently external infrastructure necessary for the implementation of developments.
