Huomattava haitta

national definition:

Maanomistajaan mahdollisesti kohdistuva haitta, jos hän ei voi alueeseensa kohdistuvan maakunta- tai yleiskaavan takia saada rakennuslupaa.
Jos em. luvan epäämisestä aiheutuisi hakijalle huomattavaa haittaa, eikä kunta tai muu julkisyhteisö lunasta aluetta tai suorita haitasta kohtuullista korvausta, lupa on kuitenkin myönnettävä (ns. "rahat tai lupa" -periaate).
Liittyy käsitteisiin "perusrakentamisoikeus" ja "ehdollinen rakentamisrajoitus".

Substantial harm

english definition:

A potential harm concerning the landowner, if he/she, due to a regional land use plan or a local master plan, is denied to grant a building permit.
If the denial in question would cause substantial harm to the applicant, the permit shall be granted, however, if the local authority or some other public entity does not expropriate the area or does not provide reasonable compensation for the said harm (the so-called "money or permit" -principle).
Relates to the terms "Basic building right" and "conditional building restriction".
