Ehitustingimused määratakse seaduste ja muude õigusaktidega, linna või valla ehitusmäärusega ning detail- ja üldplaneeringuga. Osadel juhtudel üldplaneering täpsustab õigusaktides määratud ehitustingimusi. Ehitustingimusteks on muuhulgas ehitiste sihtotstarve, hoonete maksimaalne või minimaalne korruselisus, teised arhitektuurilised nõuded. Planeerimisseaduse järgi võib ehitustingimusi kinnisvarale sätestada järgmiste plaanide alusel: linnades ja alevites ning teistel detailplaneeringu kohustusega aladel ja juhtudel detailplaneeringu alusel; üldplaneeringuga detailplaneeringu kohustuseta aladel.

Building provisions could be prescribed by legislative acts or other legal acts, building regulations of a city or rural municipality, and by a comprehensive plan. In some cases a comprehensive plan specifies the building provisions prescribed by legal acts. Building provisions include the intended use of construction works, the maximum or minimum number of storeys for buildings and other architectural requirements. According to Planning Act, building provisions may be established for immovable property on the basis of the following plans: on the basis of an adopted detailed plan where preparation of a detailed plan is mandatory; on the basis of an adopted comprehensive plan where preparation of a detailed plan is not mandatory.
