national definition:Looduskaitseseadus defineerib ranna või kalda ehitskeeluvööndi kui teatud laiusega ala, mis asetseb mere, järve, jõe, oja või kanali ääres millele on keelatud ehitada uusi hooneid või rajatisi. Ehituskeeluvööndi laius rannal või kaldal on: mererannal Narva-Jõesuu linna piires ja meresaartel 200 meetrit; mererannal, Peipsi järve, Lämmijärve, Pihkva järve ja Võrtsjärve rannal 100 meetrit; tiheasustusalal üldjuhul 50 meetrit; üle kümne hektari suurusel järvel ja veehoidlal ning üle 25 ruutkilomeetri suuruse valgalaga jõel, ojal, maaparandussüsteemi eesvoolul, kanalil ning veejuhtmel 50 meetrit; kuni kümne hektari suurusel järvel ja veehoidlal ning kuni 25 ruutkilomeetri suuruse valgalaga jõel, ojal, maaparandussüsteemi eesvoolul, kanalil ja veejuhtmel, välja arvatud dreenid ja kollektorid, ning allikal 25 meetrit. Rannal ja järve või jõe kaldal metsamaal ulatub ehituskeeluvöönd ranna või kalda piiranguvööndi piirini. Ranna ja kalda ehituskeeluvööndit võib suurendada või vähendada, arvestades ranna või kalda kaitse eesmärke ning lähtudes taimestikust, reljeefist, kõlvikute ja kinnisasjade piiridest, olemasolevast teede- ja tehnovõrgust ning väljakujunenud asustusest. Ranna ja kalda ehituskeeluvööndit võib kohalik omavalitsus suurendada üldplaneeringuga. Ranna ja kalda ehituskeeluvööndi vähendamine võib toimuda keskkonnaministri nõusolekul. Ehituskeeluvööndi vähendamiseks esitab kohalik omavalitsus keskkonnaministrile taotluse ja planeerimisseaduse kohaselt: vastuvõetud üldplaneeringu; kehtestatud üldplaneeringu muutmise ettepanekut sisaldava vastuvõetud detailplaneeringu; vastuvõetud detailplaneeringu, kui kehtestatud üldplaneering puudub. Ehituskeeld ei laiene: hajaasustuses olemasoleva ehitise õuemaale ehitatavale uuele hoonele, mis ei jää veekaitsevööndisse; kalda kindlustusrajatisele; supelranna teenindamiseks vajalikule rajatisele; maaparandussüsteemile, välja arvatud poldrile; olemasoleva ehitise esmakordsele juurdeehitisele juhul, kui juurdeehitise maht on väiksem kui üks kolmandik olemasoleva ehitise kubatuurist; piirdeaedadele. Ehituskeeld ei laiene kehtestatud detailplaneeringuga või kehtestatud üldplaneeringuga kavandatud: pinnavee veehaarde ehitisele; sadamaehitisele ja veeliiklusrajatisele; ranna kindlustusrajatisele; hüdrograafiateenistuse ja seirejaama ehitisele; kalakasvatusehitisele; riigikaitse, piirivalve ja päästeteenistuse ehitisele; tiheasustusala ehituskeeluvööndis varem väljakujunenud ehitusjoonest maismaa suunas olemasolevate ehitiste vahele uue ehitise püstitamisele; tehnovõrgule ja -rajatisele; sillale; avalikult kasutatavale teele ja tänavale; raudteele.
building exclusion zone
english definition:Nature Conservation Act defines building exclusion zone of a shore or a bank as an area with a certain width that is located on a shore or a bank of sea, lake, river, brook or canal, where it is prohibited to construct new buildings and structures. The width of building exclusion zones of shores and banks is following: 200 meters on the sea coast within Narva-Jõesuu city limits, and on the sea-islands; 100 meters on the sea coast, and the shores Lake Peipus, Lake Lämmijärv, Lake Pskov and Lake Võrtsjärv; 50 meters on the banks of water bodies within cities and towns, and in clearly defined built up areas of small towns and villages; 50 meters on the banks of lakes and reservoirs with an area of more than ten hectares, rivers with a catchment area of more than 25 square kilometres, brooks, artificial recipients of land improvement systems, canals or water ducts; 25 meters on the banks of lakes and reservoirs with an area of up to ten hectares, rivers with a catchment area of up to 25 square kilometres, brooks, artificial recipients of land improvement systems, canals or water ducts, except for drainage ditches and main sewers, and springs. In case of justified need, building exclusion zones can be extended or reduced. Local governments may extend a building exclusion zone with an adopted comprehensive plan. The areas of shores and banks and building exclusion zones may be increased by the local government on the basis of an adopted comprehensive plan. Consent to decrease the areas of shores and banks and building exclusion zones shall be given by the Minister of the Environment on the basis of an application from the local government and the following documents adopted pursuant to the Planning Act: a comprehensive plan, or a detailed plan which includes a proposal to amend the adopted comprehensive plan, or a detailed plan, in the absence of an adopted comprehensive plan. Any decrease of the areas of shores and banks and building exclusion zones enters into force as of the date of adoption of the comprehensive plan or detailed plan.
The building ban does not extend to the following works built on the basis of a comprehensive plan or detailed plan: construction works in ports or works related to water traffic and water intakes; utility networks and technical infrastructure; monitoring stations and construction works in connection with hydrographical services; construction works related to fish farming and fishing; land improvement systems, except for polders; construction works intended for national defence, border guard and rescue service purposes; extensions to existing construction works; new buildings in the yard of an existing farm which are not prescribed for the economic activities of the farm; construction works prescribed for fortification of shores and banks; public roads and streets; new buildings in an existing area occupied by construction works within densely populated areas.
Construction of new buildings and civil engineering works is prohibited within the building exclusion zones of shores and banks. The building ban does not extend to: new buildings to be constructed in the yards of existing buildings in densely populated areas which are not located within a water protection zone; civil engineering works prescribed for fortification of banks; civil engineering works necessary for servicing a bathing area; land improvement systems, except for polders; initial extension of existing construction works if the volume of the extension is less than one third of the cubature of the existing construction works; boundary fences.
The building ban does not extend to the following areas concerning which an adopted detailed plan or adopted comprehensive plan exists: construction works related to surface water intakes; construction works in ports and civil engineering works related to water traffic; civil engineering works prescribed for fortification of shores; construction works of hydrographical services and monitoring stations; construction works in connection with fish farming; construction works in connection with national defence, border guard and rescue service; erection of new construction works in the building exclusion zones of densely populated areas in the direction of land from the established building line between existing construction works; utility networks and technical infrastructure; bridges; public roads and streets; railways.
