national definition:Forudgående offentlighed er en ofte brugt betegnelse for inddragelse af offentligheden i planlægningsarbejdet, før kommunalbestyrelsen vedtager et egentlig planforslag.
Ved lokalplaner dækker forudgående offentlighed typisk de drøftelser og forhandlinger der føres med beboere i og omkring det område lokalplanen skal regulere. Kommunalbestyrelsen kan også vælge at lægge op til en mere omfattende forudgående debat før de fremlægger et lokalplanforslag. Loven stiller ikke krav om forudgående debat i forbindelse med lokalplaner.
For kommuneplantillæg der ikke er omfattet af en planstrategi, skal kommunalbestyrelsen ifølge planloven indkalde ideer og forslag (= forudgående offentlighed), før forslaget til tillæg vedtages og fremlægges. Undtaget fra kravet er ”mindre kommuneplantillæg”, dvs. ganske små rammeændringer foranlediget af et lokalplanforslag, som fx mindre reguleringer af grænserne mellem områder med forskellige anvendelsesbestemmelser eller justeringer af bestemmelser om maksimal højde, bebyggelsesprocent mv.
early public participation
english definition:Early public participation means involving the public in the planning process before a municipal council adopts a plan proposal.
For local plans, early public participation typically covers the discussions and negotiations held with the residents in and near the area affected by the local plan. The municipal council may also decide to promote more comprehensive early debate before submitting a local plan proposal. The Planning Act does not stipulate early public participation for local plans.
When adopting and publishing a municipal plan supplement not included in an adopted planning strategy, the municipal council must solicit ideas and proposals (early public participation). Minor municipal plan supplements are excepted from this provision: very minor changes to the framework due to a local plan proposal, such as minor regulation of boundary lines between areas with different land-use provisions or adjustment of provisions regarding maximum building heights, plot ratio etc.
