ekspropriation

national definition:

Ekspropriation er en offentlig myndigheds overtagelse af privat ejendom ved lov uden ejerens samtykke. I Danmark er ejendomsretten beskyttet ved bestemmelser i grundlovens § 73, som kræver bestemte betingelser opfyldt, før samfundet kan forlange ejendom afstået. Kravene er:

  • Afståelsen skal ske mod fuld erstatning,
  • Afståelsen skal ske af hensyn til almenvellet, og
  • Indgrebet skal være hjemlet ved lov.
Planloven rummer muligheder for ekspropriation. Således kan en kommunalbestyrelse ekspropriere fast ejendom, der tilhører private, eller private rettigheder over fast ejendom, når ekspropriationen vil være af væsentlig betydning for at sikre gennemførelsen af en byudvikling i overensstemmelse med kommuneplanen eller for virkeliggørelsen af en lokalplan eller en byplanvedtægt.

Expropriation means that a public authority’s assumes ownership private property by law without the owner’s content. In Denmark, ownership of property is protected by §73 of the Constitution, which requires complying with certain conditions for a public authority to demand ownership of the property:

  • full compensation must be paid for the expropriation;
  • the expropriation must be a public good; and
  • the expropriation must be in accordance with law.
The Planning Act contains opportunities for expropriating properties. Thus, a municipal council may expropriate real property that is privately owned or private rights to real property when the expropriation is materially important in ensuring the implementation of urban development in compliance with the municipal plan or in realizing a local plan or town planning by-law.
